MVA Point System Increases
The Legislature Has Increased Points Assessed for Some Traffic Violations

On October 1, 2025, the legislature quietly increased the points that are assessed for certain traffic violations. Not only do points affect your insurance rates, but your license will be suspended if you reach eight points and will be revoked if you hit twelve points. There are ways to fight an attempted suspension or revocation at an MVA hearing, but it is better not to be in that position in the first place.
The most common offense seeing an increase in points is speeding 30 or more miles over the speed limit. These offenses previously carried five points. They now carry six points. In addition, if you are 30 or more miles over the speed limit, you can also be charged with reckless driving which carries up to 60 days in jail and six points. The fines are also much higher especially for speed violations that take place in a construction or school zone.
Negligent driving used to only carry one point. Now, two points will be assessed for negligent driving. As always, you will receive three points if an accident is involved.
Aggressive driving still carries five points, but now there are many more circumstances where aggressive driving can be established. It will be much easier for the police officer or State to prove aggressive driving.
A new law allows a police officer to issue a citation to a person on a bicycle, play vehicle, or unicyle should it fail to yield the right-of-way to a pedestrian or person riding an electric mobility device. The face value of the ticket is $50.00.
The traffic laws continue to change every year. The increase in points can affect you if you already have points on your driving record.
