How to get a warrant quashed or recalled

If there is a warrant out for your arrest, an attorney may be able to file a motion to quash the warrant. A motion to quash asks the court to recall the warrant and set the case for a trial or hearing. In many circumstances, a motion to quash will usually be granted.


The most common circumstance is where a defendant fails to appear for court for a serious traffic violation or criminal case. The judge then issues a warrant for the individual's arrest. Perhaps he or she forgot about the court date, never received the Summons in the mail, or otherwise decided not to appear. An attorney can probably quash the warrant and get a court date.


Another common situation is where a judge issues a warrant for a violation of probation. An attorney can often get the warrant recalled.


If there is a warrant issued, you can be arrested at any time. Your first call should be to an attorney to see what steps can be taken to get the warrant quashed before you are arrested on the warrant.
